Mediation |
Mediation is an informal and confidential conflict management process that is geared towards problem solving. As mediators we have no decision-making power. Instead we function as neutral and impartial facilitators, helping you find voluntary and mutually acceptable resolutions. |
Mediation can be conducted with or without attorneys. The model that we use at Central Valley Family Mediation is an individual mediation model – with one mediator and no attorneys. You can stop the process at any time if you wish to consult with an attorney. And, you will be encouraged to consult with independent legal counsel and an independent CPA prior to signing any documents. |
Typically, the process of divorce mediation and document preparation takes between six and eight hours, depending on the issues and the personalities involved. Some divorces can be mediated in a single session. And, sometimes the process occurs over a few weeks time, in two, three or four face-to-face sessions. |
Document Preparation |
When mediation is complete we will prepare your Marital Settlement Agreement and use your information to fill-in the forms that you will need to present to the court. |
Your marital settlement agreement will cover your parenting plan, distribution of your assets and debts, spousal support, child support and any other issues that you believe are necessary. Our standard forms package includes a petition for dissolution, an answer, two financial disclosure affidavits, a child support guidelines worksheet, (if children are involved) and various other forms that the court needs. |
If you need complex documents, like a QDRO (which is used to divide certain types of pensions) we will refer you to legal resources. If you choose, you may have an attorney and/or an accountant review the documents. Finally, the agreement and forms will be filed with the Clerk of the Court and your case can be set for a final hearing as an uncontested dissolution of marriage. You may never have to set foot in a courtroom. |

Divorce Mediation |
If we agree to accept your case, our pricing is as follows: |
$2,800 for an 8-hour block of mediation sessions (this can be broken down into one to four separate sessions) |
| Included within that fee are the following: |
- Preparation of the written Marital Settlement Agreement with or without minor children
- Form package for filing a dissolution of marriage with or without minor children

If additional time is required beyond the 8-hour block, we bill at our standard rate of $250 per hour. |
Please Note: In order to better serve our clients we have limited our mediation practice to only 12 couples per month, so it is important to make an appointment as soon as possible in order to be assured of being served as quickly as you desire. |
